1. Key Summary

- Who We Are: Ticketwaveee Enterprise ("Ticketwaveee") is a P2P secondary marketplace. We do not own tickets, we do not organize events, and we do not set ticket prices. Prices are set by Sellers and may be higher than face value.
- The Guarantee: We hold Buyer payments in escrow. Sellers are typically paid after the event concludes to ensure ticket validity. If a Buyer does not receive valid tickets, we provide a refund (subject to our Service Fee policies).
- All Sales Final: You cannot cancel or exchange tickets once bought. If you can no longer attend, you may list the tickets for resale on our platform.
- Service Fees: We charge fees to keep the platform running. Service Fees are non-refundable, even if an event is canceled, as our service (connecting the Buyer and Seller) has been performed.
- Event Cancellations: If an event is canceled, the Ticket price is refunded to the Buyer. The Seller is responsible for reclaiming value from the original organizer.
- International Use: We operate in Malaysia, Singapore, and Thailand. Users are responsible for complying with local laws and taxes in their respective regions.
2. Introduction and Scope
2.1. Contracting Entity. These Terms and Conditions ("Agreement") constitute a legally binding agreement between you ("User", "You", "Buyer", or "Seller") and Ticketwaveee Enterprise ("Ticketwaveee", "we", "us", or "our").
2.2. Acceptance. By accessing our website (ticketwaveee.com), mobile application ("App"), or services (collectively, the "Site"), you agree to be bound by this Agreement and our Privacy Policy. If you do not agree, you must not use our Services.
2.3. Modifications. We may amend this Agreement at any time by posting the revised terms on the Site. Continued use of the Site constitutes acceptance of the amended terms.
3. The Marketplace Service
3.1. Nature of Services. Ticketwaveee is a marketplace. We provide a platform for registered Sellers to list tickets and for Buyers to purchase them.
- We are not the Seller: We do not own, inspect, or possess the tickets sold on the Site.
- We are not the Organizer: We do not create or organize events.
- Pricing: The Seller (not Ticketwaveee) sets the prices, which may exceed the ticket's original "face value".
3.2. Marketplace Safety. We do not guarantee the existence, quality, safety, or legality of the tickets advertised. However, we actively monitor our marketplace and will immediately remove listings or suspend accounts if we detect fraud, safety issues, or inaccuracies.
4. Account Registration
4.1. Eligibility. You must be at least 18 years old and able to enter into legally binding contracts to use this Site.
4.2. Account Security. You are responsible for maintaining the confidentiality of your account credentials. You are liable for all activities that occur under your account.
4.3. Verification. We reserve the right to require identification or financial documentation (KYC) to verify your identity before allowing you to list or purchase tickets.
5. Buying Tickets
5.1. Binding Contract. When you place an order, you are entering into a binding contract with the Seller to purchase the tickets. All Sales are Final. You cannot change or cancel orders after the sale is complete.
5.2. Pricing and Errors. Ticket prices are dynamic. You are responsible for reviewing the total cost, including Service Fees and taxes, before completing the transaction.
6. Selling Tickets
6.1. Listing Accuracy. When listing a ticket, you warrant that the ticket is valid and that you have the right to sell it. You must provide accurate details regarding the event, seat location, and any restrictions.
6.2. Fulfillment. Once a ticket is sold, you are contractually bound to deliver the exact ticket listed within the required delivery timeframe. Failure to fulfill orders may result in significant charges, account suspension, and forfeiture of payment.
6.3. Pricing Freedom. You determine the "Sales Price." You may modify your listing price at any time before a sale is confirmed.
7. Fees, Payments, and Taxes
7.1. Service Fees. Ticketwaveee charges Service Fees for facilitating the transaction. These fees may vary by event, ticket type, and location.
- Non-Refundable: Service Fees are strictly non-refundable. This includes scenarios where an event is canceled or rescheduled, as our marketplace services have already been rendered.
7.2. Payment Processing. We utilize third-party payment processors (including but not limited to Stripe, Fiuu, iPay88, and others) to process transactions. You agree to be bound by the applicable terms of these processors.
7.3. The Escrow Model.
- Buyers: Your payment is collected immediately upon purchase.
- Sellers: We act as a limited payment collection agent for the Seller. To ensure ticket validity and prevent fraud, ticket proceeds are held in escrow. Funds are typically released to the Seller only after the event has concluded and no buyer disputes have been raised (Wait periods apply, typically 5-10 business days post-event).
7.4. Taxes. Sellers are responsible for determining, collecting, and remitting any applicable taxes (Sales Tax, SST, VAT, etc.) resulting from their ticket sales. Ticketwaveee is not responsible for your tax liabilities.
8. The Ticketwaveee Guarantee
8.1. Scope. We want you to shop with confidence. If: (a) You do not receive your tickets in time for the event; (b) The tickets are invalid for entry; or (c) The tickets are not comparable to or better than what you ordered; You may be eligible for a refund or credit under this Guarantee.
8.2. Remedy. If a guarantee claim is verified, Ticketwaveee will, in its sole discretion: 1. Attempt to source replacement tickets; or 2. Issue a refund. Note on Refunds: Refunds typically cover the cost of the Ticket. Whether the refund includes the Service Fees or Payment Processing charges is at the sole discretion of Ticketwaveee and subject to the policies of the specific Payment Processor used for the transaction.
8.3. Abuse. We reserve the right to suspend any user who we suspect is abusing the Guarantee policy or filing false claims.
9. Event Cancellations and Postponements
9.1. Cancellation. If an event is canceled and not rescheduled:
- Buyers: You will receive a refund for the Ticket price. Service fees may not be refunded depending on the payment gateway policies. Upon receiving a refund from us, you are strictly prohibited from utilizing the ticket for any further purpose, specifically including any attempt to gain entry or to seek a refund directly from the original event organizer.
- Sellers: You will not be paid for the sale. If you were already paid, we will charge your payment method for the amount. The ticket is your property, and you must seek a refund from the original event organizer.
9.2. Postponement. If an event is postponed, the transaction remains valid. You should use the ticket for the new date or resell it on our Site. Refunds are not issued for postponed events unless the event is ultimately canceled.
10. Mobile App License
10.1. License Grant. If you access our Services via the Ticketwaveee App, we grant you a limited, non-exclusive, non-transferable license to use the App for personal use.
10.2. Third-Party Terms. Your use of the App is also subject to the standard End User License Agreements (EULA) of the relevant App Store (Apple App Store or Google Play Store). Ticketwaveee, not Apple or Google, is solely responsible for the App and its content.
11. Prohibited Content and Conduct
11.1. Misuse. You agree not to bypass our security, scrape our data, use bots to purchase tickets, or interfere with the proper working of the Site.
11.2. Stolen Property. The sale of stolen property is strictly forbidden and violates criminal law. We will cooperate with law enforcement to prosecute individuals attempting to sell stolen tickets.
11.3. User Content. By submitting content (images, text) to the Site, you grant us a worldwide, royalty-free license to use, display, and modify that content.
12. Disclaimer of Warranties and Limitation of Liability
12.1. "As Is" Basis. The Site and Services are provided on an "As Is" and "As Available" basis. We expressly disclaim all warranties of merchantability, fitness for a particular purpose, and non-infringement.
12.2. Liability Cap. To the maximum extent permitted by law, Ticketwaveee’s total liability to you for any claim arising out of this Agreement or use of the Site is limited to the greater of: (a) the total fees you paid to us in the 12 months prior to the action; or (b) RM 1,000 (or the equivalent amount in the local currency of the jurisdiction where the liability arose).
13. General Provisions
13.1. International Compliance. The Services are accessible internationally (specifically Malaysia, Singapore, and Thailand). Users are responsible for complying with all local laws and regulations applicable to the sale and purchase of tickets in their specific jurisdiction.
13.2. Indemnification. You agree to indemnify and hold Ticketwaveee harmless from any claims, losses, or damages arising out of your breach of this Agreement or your violation of any law or third-party rights.
13.3. Force Majeure. We are not liable for any failure to perform due to causes beyond our reasonable control, including natural disasters, pandemics, government sanctions, or telecommunication failures.
